These Terms of Service (“Terms”) govern your use of the Emovere website and purchases from our online store.

1. About our store

Our store is hosted on Shopify, which provides the ecommerce platform that enables us to sell our products.

References to the “website” include our storefront, its content and the services made available through it.

2. Eligibility and acceptable use

You must be legally capable of entering into a contract to place an order.

You agree not to:

  • Misuse the website.
  • Interfere with its security or operation.
  • Introduce malicious code.
  • Scrape it unlawfully.
  • Infringe another person’s rights.
  • Use it for fraudulent or illegal activity.

3. Product information

We take reasonable care to describe and display products accurately. Colours and textures may appear differently depending on your device and display settings.

Measurements are approximate, and handmade, washed or distressed products may have minor variations that form part of their design.

Product availability can change without notice. We may limit quantities where reasonably necessary, including to prevent suspected resale or fraud.

4. Prices and payment

Prices are shown in the currency selected on the website. The checkout will display applicable taxes, delivery charges and the total payable before you submit the order.

Your bank or payment provider may charge currency-conversion or other fees.

Payment is processed by the payment methods presented at checkout. You confirm that you are authorised to use the payment method supplied.

5. Orders and contract formation

Submitting an order is an offer to purchase. An automated order-confirmation email acknowledges receipt but does not necessarily mean that we have accepted the order.

A contract is formed when we confirm dispatch, unless applicable law requires otherwise.

We may reject or cancel an order before dispatch for legitimate reasons, including:

  • Product unavailability.
  • An obvious pricing or description error.
  • Failed payment.
  • Suspected fraud.
  • Breach of purchase limits.
  • Inability to deliver to the supplied address.

If payment has already been taken, we will refund the relevant amount.

6. Delivery

Delivery methods, estimates and charges are described in our Shipping Policy.

Risk of loss or damage passes to you when the goods are delivered to you or a person you identify to receive them, subject to applicable law.

7. Cancellations, returns and faulty goods

If you are a UK consumer buying online, you will generally have the right to cancel qualifying purchases within 14 days after receiving the goods, without giving a reason.

After notifying us, you generally have a further 14 days to return them. Exceptions may apply, including to personalised goods and certain sealed products once unsealed.

Products must be handled only as reasonably necessary to inspect them. A deduction may be made where value has been reduced by handling beyond what would be permitted in a shop.

Your statutory rights apply where goods are:

  • Faulty.
  • Not as described.
  • Not fit for purpose.

8. Promotions and discount codes

Promotions may be subject to additional terms, availability and stated closing dates.

Unless stated otherwise, discount codes cannot be:

  • Exchanged for cash.
  • Used after expiry.
  • Combined with another offer.

We may withdraw a promotion where continued operation would be unlawful or affected by fraud or a material technical error.

9. Intellectual property

The website and its content—including the Emovere name, designs, artwork, photographs, graphics, text and arrangement—are owned by or licensed to us and protected by intellectual-property law.

You may use the website for personal shopping only. You may not reproduce, sell, publish, modify or commercially exploit our content without prior written permission.

10. Third-party services and links

The website may use or link to services operated by third parties, including Shopify, payment providers, couriers and social platforms.

Their services may be governed by separate terms and privacy notices. We are not responsible for third-party websites that we do not control.

11. Website availability

We aim to keep the website accurate and available but do not promise uninterrupted or error-free access.

We may suspend or change parts of the website for maintenance, security or operational reasons.

12. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory consumer rights.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable, or for business losses arising from a consumer purchase.

By using the website, you acknowledge that your personal information will be handled as described there.

14. Changes to these Terms

We may update these Terms to reflect legal, technical or business changes.

The version published when you place an order will normally govern that purchase. We will update the date at the top when changes are made.

15. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain the benefit of any mandatory protections and may bring proceedings in the courts available to you under applicable law.
